Sunset Party Cruise — Participant Waiver and Release
This Waiver and Release applies to the person signing below and to every guest covered by this reservation, including all ticket holders listed on the booking.
1. Assumption of Risk
I understand that boating, boarding, moving about a vessel, swimming, and water-based recreation involve inherent risks that cannot be eliminated, including but not limited to unpredictable weather and sea conditions, sudden vessel movement, slips and falls, sun exposure, dehydration, motion sickness, and the consumption of alcohol. I knowingly and voluntarily assume all such risks on behalf of myself and my party.
2. Release and Waiver of Liability
In consideration of being permitted aboard, I release, waive, and hold harmless the vessel operator, its owners, officers, captains, crew, and agents from any and all claims, demands, or causes of action for injury, illness, death, or property damage arising out of my participation, except to the extent caused by gross negligence or willful misconduct.
3. Alcohol and Conduct
Guests consuming alcohol must be 21 or older and must do so responsibly. The captain may refuse service to any guest, end the cruise early, or remove any guest whose behavior endangers the vessel, the crew, or other guests. No illegal substances are permitted aboard. Guests who are visibly intoxicated may be denied boarding without refund.
4. Health and Fitness to Participate
I confirm that I am physically able to board and ride aboard the vessel, and that I have disclosed any medical condition, pregnancy, recent surgery, or medication that could affect my safety or the safety of others. I agree to follow all safety instructions given by the captain and crew.
5. Guests in My Party and Minors
I am the booking contact and I am authorized to sign on behalf of every guest on this reservation. Any guest under 18 years of age will be accompanied by a parent or legal guardian for the duration of the cruise, and I accept responsibility for their supervision and for signing on their behalf.
6. Personal Property
The operator is not responsible for loss of or damage to personal property brought aboard, including phones, cameras, clothing, and personal items. Items left aboard after the cruise are held for a limited time and may be discarded.
7. Weather, Route and Schedule Changes
The captain has sole authority over the route, speed, and duration of the cruise and may shorten, alter, or cancel a departure at any time for safety or weather reasons. Rescheduling and refunds in those circumstances follow the operator's published cruise policies.
8. Emergency Medical Consent
I consent to emergency medical treatment for myself and the guests in my party if the need arises while aboard or at the dock, and I accept responsibility for any costs associated with that treatment.
9. Photography and Video
Photographs and video taken by the operator or its crew during the cruise may be used for marketing and social media. Notify the crew at boarding if anyone in your party does not wish to appear.
10. Governing Law
This waiver is governed by the laws of the State of South Carolina. I have read it, I understand it, and I sign it freely and voluntarily.
Signing electronically has the same effect as signing on paper. We record your name, signature, and the time you signed.
